Extended Terms and Conditions for Genesis NX

Wellness & Mindfulness Workshop, Retreat

These Retreat Terms and Conditions ("Terms") form an extension to the primary Terms and Conditions of Genesis NX Pte Ltd ("Genesis NX", “we”, “our” or “us”) and apply specifically to all participants (“you”, “participant”, or “user”) registering for or attending any Wellness or Mindfulness Retreat programs offered under Genesis NX Pte Ltd through www.genesisnx.com, www.gnxfit.com, or any other affiliated websites, applications, or booking platforms.

By registering for any retreat, workshop, or wellness service provided under Genesis NX, you acknowledge that you have read, understood, and agreed to be bound by these Terms, in addition to our main Terms and Conditions and Privacy Policy.

1. Eligibility and Health Responsibility

1.1 Participant Responsibility:
You affirm that you are physically, mentally, and emotionally fit to participate in the activities provided as part of the retreat program, including but not limited to yoga, mindfulness, HIIT training, sound healing, breathwork, and any guided physical, meditative, or spiritual practices.

1.2 Medical Clearance:
You agree to consult a medical professional prior to participation. Genesis NX does not provide medical diagnosis or treatment. Participation is at your own risk, and Genesis NX disclaims liability for any injury, illness, loss, or condition that may result from your involvement.

2. Booking, Payments, Refunds, and Agenda Changes

2.1 Booking Confirmation:
A booking is only confirmed upon full or partial payment, subject to the terms of the specific retreat or product offering.

2.2 Refunds and Cancellations (User-Initiated):
All refund requests are subject to the refund policy associated with the specific product or service and solely at the discretion of Genesis NX. Refunds, if provided, may be subject to administrative fees or cancellation charges. No refunds will be given for failure to attend the retreat due to personal circumstances, illness, scheduling conflicts, or visa issues.

2.3 No Liability for Travel or External Bookings:
Genesis NX shall not be liable for any travel arrangements, hotel bookings, third-party accommodation, transportation costs, visa issues, or any related expenses incurred by the participant, regardless of whether the retreat proceeds or is cancelled.

2.4 Cancellation by Genesis NX:
We reserve the right to cancel, reschedule, or modify any retreat due to force majeure events, low participation, public health concerns, travel restrictions, natural disasters, venue issues, or any other unforeseen circumstances. In such events, Genesis NX may provide a refund or offer a credit or transfer option, but will not be responsible or liable for any consequential losses, including but not limited to travel, hotel, or incidental costs.

2.5 Agenda Flexibility & Non-Refundability:
Genesis NX reserves the right to amend, modify, or re-sequence the retreat agenda at any time, including last-minute changes, to respond to unpredictable circumstances such as weather conditions, public safety concerns, facilitator availability, health emergencies, venue limitations, or group requests arising from the majority of participants. While Genesis NX will make all reasonable efforts to notify participants of such changes in advance, no refunds shall be issued in the event of agenda modifications, regardless of the cause. Participants accept that flexibility is integral to the nature of retreat experiences.

2.6 Processing Delays in Refunds (If Applicable):
If a refund is approved, you acknowledge and agree that Genesis NX cannot be held liable for delays in processing such refunds due to internal administrative processes, payment gateway issues, or delays caused by third-party financial institutions, including but not limited to credit card processors, banks, or payment apps. Refunds may take between 7 to 30 business days depending on the method of payment and jurisdiction.

3. Code of Conduct and Risk Acceptance

3.1 Participant Conduct:
Participants are expected to conduct themselves respectfully toward other guests, instructors, staff, and the venue. Genesis NX reserves the right to terminate participation without refund for any behavior deemed inappropriate, dangerous, disrespectful, or disruptive.

3.2 Voluntary Participation & Risk Assumption:
All activities are voluntary and may involve inherent risks. You accept full responsibility for your participation and understand that Genesis NX, its instructors, and affiliates will not be liable for any accident, injury, loss, emotional distress, or damage that may occur during the retreat.

4. Intellectual Property and Media Consent

4.1 Use of Materials:
All retreat content, including printed materials, session content, visual media, and recordings, are the intellectual property of Genesis NX and may not be copied, recorded, or distributed without written consent.

4.2 Photography and Video Consent:
Participants consent to the use of photos, videos, or recordings taken during the retreat for marketing, training, and promotional purposes unless written objection is submitted prior to or at the start of the retreat.

5. Limitation of Liability

5.1 No Liability for Indirect or Consequential Damages:
Genesis NX shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to personal injury, mental distress, travel disruption, or financial loss resulting from participation in the retreat.

5.2 No Warranty of Results:
Genesis NX makes no guarantees regarding the effectiveness of any retreat or its ability to produce any specific physical, emotional, or spiritual outcome. Participation is not a substitute for medical, psychological, or professional advice or treatment.

5.3 Third-Party Providers:
Genesis NX is not responsible for any service interruptions, actions, or negligence of third-party venues, travel providers, instructors, or partners involved in delivering the retreat.

6. Force Majeure

Genesis NX shall not be held liable for any failure or delay in performance of its obligations where such failure or delay results from causes beyond reasonable control, including but not limited to acts of God, natural disasters, pandemics, health emergencies, government actions, venue restrictions, war, or civil unrest.

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore. Any dispute, controversy, or claim arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

8. Updates and Modifications

Genesis NX reserves the right to amend these Terms at any time without prior notice. Updates will be effective immediately upon publication. It is your responsibility to review these Terms regularly. Continued participation after changes constitutes acceptance of the updated Terms.
